2. Purpose
These Terms and Conditions of Sale (T&Cs) govern the sales of busts and miniatures to be painted, handcrafted by Christophe Garreau, hereinafter referred to by his trade name, Darkhat Miniatures. Placing an order implies full and unconditional acceptance of these T&Cs.
3. Products
The busts and figurines sold are unique reproductions of handcrafted works, made by hand in high-quality polyurethane resin, using traditional molding and casting techniques. Each piece is originally sculpted by the artist and then reproduced in resin. The photographs are non-contractual and for illustrative purposes only. Dimensions and colors may vary slightly.
4. Orders
Orders can only be placed through the website. An order is confirmed upon full payment and email confirmation. Darkhat Miniatures reserves the right to cancel or refuse any order for a valid reason.
The casting is made especially for you after your order. Each piece is then poured, prepared, and inspected in our workshop, ensuring a unique figurine crafted with the utmost care. Orders are generally processed and shipped within 21 days. This timeframe is provided for reference only and may vary depending on the availability and delivery times of the materials used in production. When a product is on “pre-order,” longer preparation times may apply and will be communicated to the buyer.
5. Prices, Payment, and Customs Fees
Prices are indicated in euros (€), all taxes included (TTC – VAT not applicable, Article 293 B of the French Tax Code), excluding shipping costs. Payment is made online using the secured methods offered on the website (PayPal, credit card, etc.). You can view our Security Policy here.
For deliveries outside the European Union, customs duties or other local taxes (import duties, state taxes, etc.) may be required. Unless otherwise specified, these duties and taxes are the buyer’s responsibility and must be handled directly by the buyer, both in terms of declarations and payment to the relevant authorities.
For shipments to the United States in particular, the indicated shipping fees include customs charges calculated by Colissimo for the importation of original unpainted collectible sculpture. Any additional customs duties that may apply remain the sole responsibility of the buyer..
6. Delivery
Products are delivered to the address provided by the customer at the time of order. Delivery times are indicative and may vary depending on availability and the carriers. Darkhat Miniatures cannot be held responsible for delays or lost parcels caused by the carriers.
7. Replacement and Returns
Despite careful product inspection, if one or more items are found to be defective, please contact Darkhat Miniatures via the contact form, providing your order number.
Replacement conditions:
- The product must be returned in the same condition as it was originally sent.
- Return shipping costs are the responsibility of the customer unless otherwise agreed.
- Darkhat Miniatures reserves the right to offer a replacement or a partial refund, depending on the case.
As each product is a unique, made-to-order item intended for collectors and experienced painters, it cannot be subject to a standard withdrawal return.
8. Liability
Darkhat Miniatures is committed to providing products that conform to the description and meet artisanal quality standards. However, the seller’s liability is strictly limited to the replacement or refund of the concerned product in case of a proven defect. Darkhat Miniatures shall in no case be held liable for any other damages, in particular:
indirect, consequential, or immaterial damages, such as loss of income, loss of items, or moral prejudice;
improper use of the products by the customer, including painting, improper storage, or handling not in accordance with instructions, or if the product is left in the hands of a child under 14 years old;
delays, lost parcels, or incidents related to carriers or to circumstances beyond its control (force majeure, strikes, weather conditions, etc.).
9. Intended Audience
The busts and miniatures sold by Darkhat Miniatures are intended exclusively for collectors and miniature painters. These products may contain small parts and fragile pieces. They are not toys and are not suitable for children under 14 years old.
10. Intellectual Property
The busts and miniatures sold, as well as texts, logos, images, videos, and other content created by Darkhat Miniatures, are protected by copyright and are the exclusive property of Christophe Garreau. Rights belonging to third parties are indicated where applicable. Any reproduction, distribution, or use, in whole or in part, without the express permission of Christophe Garreau is strictly prohibited.
11. Personnal Data
Data collected during the ordering process is used solely for order processing and customer relationship purposes, in accordance with the GDPR. For more information, please refer to our Privacy Policy.
12. Applicable Law and Competent Courts
The application of these Terms and Conditions of Sale, as well as any dispute relating to sales contracts concluded with the seller, shall be governed exclusively by French law. In the event of a dispute concerning their formation, interpretation, or performance, the parties shall endeavor to seek an amicable resolution. Failing an amicable agreement, any dispute shall be submitted to the french competent courts within the jurisdiction of Darkhat Miniatures’ registered office, notwithstanding multiple defendants or third-party claims.
